Understanding Florida Real Estate Closing Taxes & Fees
Unlike states with county transfer taxes or deed excise variances, Florida has very strict statewide statutory rates for recording deeds and mortgages, codified in the Florida Statutes.
1. Florida Deed Documentary Stamps (Fla. Stat. § 201.02)
Florida levies a documentary stamp tax on the transfer of real estate title at the rate of $0.70 per $100 (or fraction thereof) of the gross sales price across Northeast Florida (Duval, Clay, St. Johns, Nassau, Baker, Bradford, Putnam). By custom, the seller pays this tax at closing.
2. Promissory Note Doc Stamps (Fla. Stat. § 201.08)
Whenever a buyer takes out a mortgage to finance a property, the state charges $0.35 per $100 on the face amount of the promissory note. Cash buyers pay $0 for this fee.
3. Florida Intangible Tax on Mortgages (Fla. Stat. § 199.133)
Florida charges a nonrecurring intangible personal property tax of 2 mills ($0.002 per dollar) on the total mortgage obligation secured by Florida real estate. On a $300,000 mortgage, this equals exactly $600.
4. Promulgated Florida Title Insurance Rates (FAC 69O-186.003)
Title insurance premiums in Florida are regulated by the state insurance commissioner. Every title company uses the same statutory minimum rate: $5.75 per $1,000 for the first $100,000 of purchase price, and $5.00 per $1,000 up to $1,000,000. When an owner's policy is issued, the simultaneous lender's loan policy is just $25 flat.
